(hereinafter referred to as Encanto da Veiga).
Mirtienergia Lda. is the data controller within the meaning of the General Data Protection Regulation (hereinafter referred to as the “GDPR”).

Your personal data may be collected and processed for the following purposes:
a)To comply with legal obligations to which Mirtienergia Lda. is subject, including obligations relating to guest registration, the communication of legally required information to the competent authorities and invoicing.
b) For the purpose of performance of Temporary accommodation contract for tourists or the Local Accommodation Management Contract celebrated with Mirtienergia Lda, particularly payment transactions, management of check-in’s and check-out’s, management of guests, charge a deposit, providing complementary services to the stay as cleaning, transfers and breakfast
or grocery services, contractual obligation management or for pre-contractual diligence
purposes.
c) To communicate with guests by telephone, email or other digital means, including responding to enquiries, providing information relating to bookings and stays and, where applicable and with the appropriate legal basis, sending marketing communications.
d) To protect the property and assets of Mirtienergia Lda., as well as for statistical and service improvement purposes, where applicable.
Failure to provide personal data that is necessary for legal or contractual purposes may prevent Mirtienergia Lda. from complying with its legal obligations or from providing the requested accommodation services.
What kind of personal data do we collect?
Within the scope of its activity, Mirtienergia Lda. may collect and process the personal data necessary to manage bookings, provide accommodation services, respond to enquiries and comply with legal obligations, including identification data, contact details, booking information, billing information and, where applicable, payment-related data.
What do we treat your information for?
The processing of your personal data may be based on the performance of an accommodation contract or on steps taken at your request prior to entering into such a contract, as well as on compliance with legal obligations applicable to Mirtienergia Lda., in accordance with Article 6(1)(b) and (c) of the GDPR.
Where the processing of personal data is based on your consent, such processing will be carried out in accordance with Article 6(1)(a) of the GDPR.
Where applicable, Mirtienergia Lda. may also process personal data on the basis of its legitimate interests, provided that such interests do not override the rights and freedoms of the data subject, in accordance with Article 6(1)(f) of the GDPR.
How long have do we keep your personal data?
Without prejudice to legal provisions, regulatory or judicial determination in contrary, the
personal data collected shall be kept only for the minimum period necessary for the
purposes which have motivated their collection or subsequent treatment.
Who can we transmit your personal data?
MirtienergiaLda. may need to share some of your personal data with other recipients.
These recipients include:
a) Organizations and/or companies affiliated to MirtienergiaLda. whenever they respect an equivalent
policy on the protection of personal data.
b) Public entities to which MirtienergiaLda is legally obliged to provide information, in particular the
Foreign and Border Services and the DGCI – Directorate-General for Taxes.
c) Service providers acting on behalf of Mirtienergia Lda., where necessary for the operation of the accommodation and website, such as IT and website service providers, booking and payment service providers, accounting services, cleaning services and professional advisers, where applicable.
d) Competent authorities to which MirtienergiaLda is legally obliged to disclose information during judicial proceedings or to detect technical and/or security problems, such as judicial entities
or competent control authorities.
Are my data transferred to countries outside the European Union?
Your personal data, collected by MirtienergiaLda, will not be transferred to any entity established
outside the territory of the European Union.
Exceptionally and subject to certain conditions, MirtienergiaLda may transfer your personal data to
countries outside the territory of the European Union, in accordance with the applicable
legislation, namely for the purposes of data hosting or storage, technical processing
subcontracting, back-up and recovery of hosted data, development of services.
MirtienergiaLda assures you that it will not transfer your personal data to countries that do not
guarantee an adequate level of protection, in accordance with the provisions of the GDPR.

At any time, in accordance with GDPR, you may request access to your personal data, as
well as to its rectification or deletion, limitation of the treatment performed, the right of
opposition and the right to data portability.
Where requests are manifestly unfounded or excessive, in particular because of their repetitive nature, Mirtienergia Lda. may charge a reasonable fee or refuse to act on the request, in accordance with the GDPR.
Where the processing of your personal data is based on consent, you have the right to withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing carried out before its withdrawal.
You also have the right to lodge a complaint with the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados – CNPD).
